I. Standard Business Terms
§ 1 Basic Provisions
The following Terms and Conditions apply to all contracts concluded between you and us as the supplier (Spices of Asia) via our website.
Unless expressly agreed otherwise, the inclusion of any of your own terms and conditions is excluded.
A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
A business entity is any natural or legal person or legally responsible partnership acting in the exercise of their commercial or independent professional activity.
§ 2 Conclusion of the Contract
The subject matter of the contract is the sale of goods offered on our website.
By placing products on our website, we make a binding offer to conclude a purchase contract under the conditions stated in the product description.
The contract is concluded via the online shopping cart system as follows:
The products selected for purchase are placed in the shopping cart.
You can review and modify your cart at any time.
After proceeding to checkout and entering your personal details, all order information is displayed on the order summary page.
Before submitting your order, you may review, correct, or cancel your order.
By clicking the “Purchase” or “Order” button, you submit a legally binding acceptance of our offer. The purchase contract is thereby concluded.
Any inquiries you make regarding offers outside the shopping cart system are non-binding. We may provide you with a binding offer in text form (e.g. by email), which you may accept within 5 days.
Order processing and contract-related communication take place primarily by email. You must ensure that the email address you provide is correct and that emails from us can be received (e.g. not blocked by spam filters).
§ 2a Special Provisions for Perishable Goods (e.g. Fresh Mangoes)
Exclusion from the Right of Withdrawal
Perishable goods, including fresh fruits such as mangoes, are excluded from the statutory 14-day right of withdrawal in accordance with applicable law. Further details are provided in our Cancellation Policy.
24-Hour Complaint Period
Due to the natural characteristics of fresh produce and the inability to inspect the internal condition of fruits, complaints regarding perishable goods must be reported within 24 hours of delivery. After this period, refunds or replacements cannot be offered.
Storage Responsibility
Upon delivery, you are responsible for proper storage and timely consumption of perishable goods. We recommend inspecting all fresh products immediately upon receipt.
§ 3 Right of Retention and Reservation of Ownership
You may only exercise a right of retention insofar as it relates to claims arising from the same contractual relationship.
The goods remain our property until full payment has been made.
§ 4 Warranty
Statutory warranty rights apply.
Consumers are requested to inspect the goods for completeness, visible defects, and transport damage immediately upon delivery and to notify us promptly in writing. Failure to do so does not affect your statutory warranty rights.
§ 5 Choice of Law and Jurisdiction
German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of law applies only insofar as it does not deprive consumers of mandatory protections of their country of residence.
If you are acting as a business entity, the place of jurisdiction and place of performance shall be our place of business. This does not affect mandatory statutory jurisdiction provisions.

3. Contract Language and Storage of Contract Text
The contract language is English.
The contract text is not stored permanently by us. Before submitting your order, you may print or save the contract details using your browser’s print function. After order submission, you will receive order details and legally required information by email.
4. Codes of Conduct
We do not currently subscribe to any specific codes of conduct.
5. Main Characteristics of the Goods
The essential characteristics of each product can be found in the respective product description on our website.
6. Prices and Payment Conditions
All prices listed are total prices. Due to VAT registration being pending, VAT may not be shown separately.
Payment method:
Cash on delivery only
Payment is due upon delivery of the goods.
7. Delivery Conditions
Delivery is carried out exclusively by our local delivery service and is limited to selected regions around the Bodensee area.
Delivery dates and time slots are communicated individually via email or WhatsApp.
For consumers, the risk of accidental loss or deterioration of goods passes to you only upon delivery.
8. Statutory Warranty Rights
Liability for defects is governed by § 4 of these Terms and Conditions.
9. Protection of Minors
No alcoholic products are sold via our Services.
